Acceptance of Terms

By accessing or using our website at https://kleineakker.co.za (“the Site”) and/or placing an order through our Site, you agree to be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the Site or placing orders through it.

Products and Fair Distribution Policy

As a small-scale producer committed to sustainable farming practices, Kleine Akker produces limited quantities of premium farm products with each harvest. To ensure fair distribution and give all our customers the opportunity to enjoy our products:

Purchase Limitation: We limit oil purchases to a maximum of 5 liters per customer per harvest season. This policy reflects our commitment to sharing our limited production fairly among our community of customers.

In seasons when our harvest yields excess stock beyond anticipated demand, we may notify our customers of the opportunity to place additional orders exceeding the standard purchase limitation. These special purchasing opportunities will be communicated directly to our customer base and will have their own terms and time limitations as specified in the notification.

In the interest of fairness to all customers, we reserve the right to:

• Cancel orders that appear to circumvent this purchase limitation
• Refuse service to customers who have repeatedly attempted to bypass these limitations

We thank you for your understanding and cooperation as we strive to serve our entire customer community equitably.

Account Registration

When creating an account on our Site, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device.

Ordering Process

By placing an order through our Site, you are making an offer to purchase products. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any orders for any reason, including but not limited to:

• Product unavailability
• Errors in product or pricing information
• Suspicion of fraudulent activity
• Violation of purchase limitations

Prices and Payment

All prices are in South African Rand (ZAR). Prices are subject to change without notice. Payment must be made in full at the time of ordering. We accept Credit Card & Instant EFT payment via Yoco.

Shipping and Delivery

We use The Courier Guy for all deliveries. Delivery timeframes are estimates only and may vary. We are not responsible for delays outside our control. Risk of loss and title for items purchased pass to you upon delivery to the carrier.

Returns and Refunds

If you are not entirely satisfied with your purchase, we offer a return policy within 14 days of delivery, provided that:

• Products are unused, unopened, and in their original packaging
• Proof of purchase is provided
• Return shipping costs are covered by the customer unless the product is defective

Product Quality

We take pride in our products and strive to ensure they meet high-quality standards. Our farm products are natural and may vary in appearance, flavor, and consistency between harvests due to seasonal and natural factors.

Intellectual Property

The content on our Site, including text, graphics, logos, images, and software, is the property of Kleine Akker and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, display, or create derivative works from this content without our express written permission.

Limitation of Liability

To the maximum extent permitted by law, Kleine Akker shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Site or products purchased through the Site.

Indemnification

You agree to indemnify, defend, and hold harmless Kleine Akker, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from your use of the Site, violation of these Terms, or infringement of any rights of a third party.

Dispute Resolution

Any dispute arising from these Terms and Conditions will first be resolved through good-faith negotiations. If such negotiations fail, the dispute shall be resolved through mediation or arbitration in accordance with South African law.

Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site following the posting of revised Terms constitutes your acceptance of the changes.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
